JFBS, Inc's, trading as Guguchu.com (“Guguchu”), mission is to provide online tools for musicians that are easy to use, powerful and useful. It offers easy to use, rich products for gig booking, fan development, communication, promotion, distribution, and more. By visiting the www.guguchu.com website, domain and any other linked pages, features, content, or application services offered from time to time by Guguchu in connection therewith (collectively, the "Site"), or using any of our services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.
Your privacy is very important to us. To help you understand how your privacy is protected we provide an explanation of various parts of the system below. By using Guguchu, you consent to the collection and use of your personal information as outlined in this Privacy Policy.
When you visit Guguchu you provide us with two types of information: personal information you knowingly choose to disclose that is collected by us and Site use information collected by us as you interact with our Site.
When you register with Guguchu, you provide us with certain personal information, such as your name, mailing address, email address, telephone number and age and any other personal or preference information that you provide to us.
When you enter Guguchu we collect your browser type and IP address. This information is gathered for all Guguchu visitors. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to Guguchu. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature.
When you use Guguchu, you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, listen to music, buy music and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or listen to music you previously heard. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
Any photos, messages, instant messages, emails you post (“Member Content”) on the Site is done at your own risk. We cannot control the actions of other members with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that Member Content you post on the Site will not be viewed by unauthorized persons. You understand and acknowledge that, even after removal, copies of Member Content may remain viewable in cached and archived pages or if other members have copied or stored your Member Content.
Any improper collection or misuse of information provided on Guguchu is a violation of the Guguchu Terms of Service and should be reported to privacy@guguchu.com.
Guguchu may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the Guguchu service through the operation of the service in order to provide you with more useful information and a more personalized experience.
As a condition to using certain features of our website and services (including, without limitation, the free download feature), you may be required to provide certain personal information to relevant bands, such as your e-mail address, country of residence and zip/postal code ("Fan Information") in order to join the relevant band's mailing list. As a condition to each such band's right to receive such Fan Information, Guguchu requires each band to agree that it 1) will not disclose, rent, or sell any Fan Information to any third party, 2) will use the Fan Information only in connection with the band's mailing list, in order to provide fans with general information and news about the band, and 3) will ensure that any e-mail sent to its mailing list will include a mechanism by which the recipient can unsubscribe from the mailing list, along with clear instructions on how to do so (i.e. a functioning "opt-out" mechanism). However, Guguchu has no control over and no liability for the use of the Fan Information by the bands. You can choose not to provide such Fan Information, but you may not be able to take advantage of the associated features.
By using Guguchu, you are consenting to have your personal data transferred to and processed in the United States.
Privacy of Children
Guguchu is not directed to children under the age of 13. We operate our site in compliance with the Children's Online Privacy Protection Act of 1998, and do not permit registration by, and will not knowingly collect or use personally identifiable information from, anyone under 13 years of age. This requirement is clearly posted during the registration process.
Use of Information Obtained by Guguchu
When you register with Guguchu, you create your own profile. Your profile information, as well as your name, email and photo, are displayed to people in the networks specified in your privacy settings to enable you to connect with people on Guguchu. We may occasionally use your name and email address to send you notifications regarding new services offered by Guguchu that we think you may find valuable.
Profile information is used by Guguchu primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings (e.g. locked or unlocked messages).
Your name, your age, and profile picture thumbnail will be available in search results across the Guguchu network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your profile information unless they have a relationship to you (friend, friend of friend, member of a group you belong to, etc.) that allows such access based on your privacy settings.
Guguchu may send you service-related announcements from time to time through the general operation of the service. For instance, if a friend sends you a new message, recommends a song or playlist to you, you may receive an email alerting you to that fact.
Generally, you may opt out of such emails from the notifications page, though Guguchu reserves the right to send you notices about your account even if you opt out of all voluntary email notifications.
Guguchu may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people in a group like a band or personalizing advertisements and promotions so that we can provide you Guguchu. We believe this benefits you. You can know more about the world around you and, where there are advertisements, they're more likely to be interesting to you. For example, if you put a favorite band in your profile, we might serve you an advertisement highlighting a gig of a similar band in your town.
Third Parties/Advertisers and Your Information
Guguchu may provide links to third party websites or allow other companies, called third-party ad servers, to display advertisements to users. Ad server companies can write and read their own cookies on your computer, just as if you had requested a web page from their website. Guguchu is not responsible for, and does not have any control over, the privacy practices or the content of such third parties. We encourage users to read the privacy policies of any website visited.
Please note that information stored or cached on other users' computers is subject to those users security practices, which are beyond Guguchu's control. Although we make good faith efforts to store information collected or stored by Guguchu in a secure manner, we cannot guarantee complete security. Information held by Guguchu will be maintained for a length of time appropriate to our business needs.
User Options and Responsibilities
Your user profile contains information about you that you may want to share with others. Protecting the privacy of your profile is your responsibility. We caution you not to share sensitive information (such as social security numbers, credit card numbers, or driver's license numbers) with other users whom you do not know or place such information in your profile.
Any information you choose to display on Guguchu, including your profile, will be viewable by the entire Web (i.e., everyone). For your own safety we caution you not to include home addresses, telephone numbers or any other personal information that could allow strangers to contact you outside of the Guguchu service.
To maintain privacy it is also important not to share your password with anyone. Selecting a longer password with a mix of letters, numbers and symbols makes it more difficult for others to guess your password. It is also helpful to change passwords on a regular basis.
Identity theft is a serious concern to all of us. To help protect yourself against identity theft, please remember that Guguchu will NEVER ask for your password in either a non-secure or unsolicited email communication.
It is your responsibility to select the desired privacy setting upon creation. Other items may inherit an existing privacy setting. In this case, it is your responsibility to understand the associated privacy setting before creating content to ensure the handling of your information meets your expectations.
You may choose to correct or update the information you have submitted to us by editing your profile or account information. If you remove your information, it may continue to persist on back-up media.
Changes and Updates
Guguchu's Privacy Policy may change from time to time. If we make any substantive changes to our policies, we will notify registered users by posting bulletins on the Guguchu service, by email at the address provided by you, or by posting notice of changes at Privacy Policy. Your use of the website or the Guguchu software after the changes constitutes your agreement with regard to information collected from you in the past and in the future.
